Rule 115
Inspection and Acceptance of Goods

(1) The public body shall inspect or test whether the supplied goods are in accordance with the technical specifications and quality mentioned in the contract.
(2) When carrying out inspection or testing according to sub-rule (1), if there is a prevailing law related to goods inspection or testing, it shall be done in accordance with that law and if not, it shall be done in accordance with the procedure mentioned in the purchase agreement. If there is no such procedure, it should be done according to the procedure deemed appropriate by the public body.
(3) For the purpose of sub-rule (1), the relevant public body may appoint one or more bodies or officials for the purpose of such inspection or testing or constitute a committee consisting of at most three experts related to the goods concerned.
(4) When inspecting or testing the goods supplied by the body, officer or committee as per sub-rule (3), if such public body keeps the sample and specification of such goods under seal, it shall be examined according to such sample and specification. During such inspection, the goods conforming to such samples and specifications shall be approved and the goods not conforming shall be returned to the supplier.
(5) According to sub-rule (4) during inspection or testing, all the goods or samples thereof may be selected and inspected or tested as required.
(6) After inspecting or testing the agency, officer or committee according to sub-rules (4) and (5), they shall prepare an inspection report mentioning the details of the approved and rejected goods. In such a report, the name, percentage, specification, inspection or test results of the checked goods should be mentioned and such report should be kept by the public body as a record of the procurement process.
(7) If any dispute arises between the inspecting or testing agency, officer or committee and the supplier during the inspection or testing of the goods in accordance with this rule, such dispute shall be resolved in accordance with the dispute resolution procedure mentioned in the purchase agreement.
(8) ThisNotwithstanding anything written elsewhere in the rules, goods worth up to twenty five thousand rupees may be seized by the head of the warehouse branch of the public body after necessary inspection or testing.
